It emphasized that the SRA must provide landowners with a clear opportunity to propose redevelopment plans before resorting to compulsory acquisition. The court found that the SRA had failed to recognize the petitioner's rights and had not issued the necessary notices to allow the landowner to act on their intentions to redevelop.
The court quashed the SRA's notice for acquisition and ordered the authority to recognize the petitioner's preferential rights to redevelop the land. The petitioner was directed to submit a redevelopment proposal within eight weeks, which the SRA must consider in accordance with the law. This ruling reinforces the legal protections afforded to landowners in slum rehabilitation contexts, ensuring that their rights are upheld against arbitrary state actions.
