The applicant's counsel argued that: - The loans were taken by the company, and Singhee was not directly responsible for the repayment. - The account was declared a Non-Performing Asset (NPA) retroactively, and no charge sheet had been filed in the predicate offence. - The Delhi High Court had previously struck down the bank's classification of the company as a "Wilful Defaulter."
Conversely, the Enforcement Directorate contended that: - The applicant was involved in a conspiracy to siphon off funds through shell companies. - The serious nature of the allegations warranted the denial of bail under the stringent provisions of the PMLA.
The court analyzed the arguments presented by both sides, emphasizing the principle that "bail is the rule and jail is the exception." It noted that Singhee had been in custody for an extended period without a charge sheet being filed in the predicate offence, which infringed upon his right to a speedy trial as guaranteed under Article 21 of the Constitution. The court highlighted that the existence of a scheduled offence is essential for establishing proceeds of crime under the PMLA, and since the trial for the predicate offence was unlikely to conclude in a reasonable time, the conditions for granting bail were met.
The Allahabad High Court ultimately decided to grant bail to Padam Singhee, imposing several conditions to ensure compliance with the legal process. The court ordered him to furnish a personal bond and two sureties, deposit his passport, and refrain from tampering with evidence or influencing witnesses. This ruling underscores the judiciary's commitment to upholding individual rights while balancing the interests of justice in cases involving serious allegations.
