In a significant ruling, the High Court has overturned the discharge of former Tamil Nadu Minister Thangam
The prosecution argued that the discharge was improperly granted based on a closure report that contradicted earlier findings. They contended that the DVAC had initially presented a strong case against the accused, which was undermined by a subsequent investigation that appeared to favor the defendants after a change in political power. The defense, on the other hand, claimed that the subsequent investigation revealed legitimate sources of income and that the initial allegations were unfounded.
The court scrutinized the process leading to the discharge, highlighting a pattern of manipulation by the DVAC to benefit the accused after they regained political power. It noted that the closure report, which absolved the accused, was based on new arguments presented by the defense that had not been part of the original investigation. The court emphasized that the integrity of the investigation process must be maintained and that the DVAC's actions raised serious concerns about bias and collusion.
The High Court set aside the discharge order, reinstating the case for further proceedings. It directed the Special Court to frame charges against
