The university had demanded the payment of the last installment amounting to Rs. 7.5 lakhs by November 10, 2024, threatening to disable all web portal services to the college if the payment was not made.
The petitioner sought additional time to fulfill the payment obligation, indicating no challenge against the university's notice. The university's counsel, however, argued that the petitioner had already been granted multiple opportunities to make the payment, which had not been fulfilled. They contended that no further indulgence should be shown to the petitioner due to the repeated defaults.
The court acknowledged the university's position but also recognized the petitioner's request for a breathing period to make the payment. It noted the importance of providing reasonable opportunities for compliance, especially in the context of educational institutions that play a vital role in society. The court decided to balance the interests of both parties by allowing the petitioner a chance to meet the financial obligation.
The court disposed of the writ petition by directing the university to keep the notice in abeyance, provided the petitioner pays Rs. 2.5 lakhs within two weeks and the remaining amount within one month thereafter. The court warned that failure to comply with these payment terms would result in the loss of the granted benefit, allowing the university to proceed with the actions outlined in the original notice.
This ruling underscores the court's commitment to ensuring that educational institutions are given fair opportunities to meet their financial responsibilities while also holding them accountable for compliance.
