The accident occurred on March 26, 2010, when Vijayakumar was a pillion rider on a motorcycle that collided with the bus, resulting in severe injuries that led to his death shortly after. His wife, daughter, and mother filed a petition seeking compensation of Rs. 47,00,000, alleging negligence on the part of the bus driver.

The insurance company, which was the appellant in this case, contended that the accident was due to the rash driving of the motorcycle rider and sought to dismiss the claim. They argued that the tribunal had erred in calculating the deceased's monthly income, awarding compensation for pain and suffering in a death case, and in the amounts awarded for loss of consortium and love and affection.
