The case arose from a partition suit filed by Kolli Somulamma and her daughter against Kolli Adilakshmi and others, concerning the division of family properties following the death of Kolli Kannamanaidu . The plaintiffs sought a partition of the properties into 12 equal shares, claiming their rights as the widow and daughter of the deceased.

Arguments

The plaintiffs argued that they were entitled to a share of the properties as legal heirs of Kolli Kannamanaidu , who died intestate. They contended that the defendants had mistreated them and wrongfully excluded them from the family estate. Conversely, the defendants claimed that a registered adoption deed and a will executed by Kolli Konda (the father of Kolli Kannamanaidu ) bequeathed the properties to the fifth defendant, thereby invalidating the plaintiffs' claims.

The court meticulously examined the validity of the adoption and the will. It found that the adoption deed was not proven according to legal standards, as key witnesses failed to provide credible evidence regarding the adoption ceremony.
