They maintained that the elections were conducted in accordance with the accepted list of members of the Society, which had been recognized by the Deputy District Magistrate in a prior order.
Conversely, the respondent contended that the elections were illegal because they were held by a Committee whose term had expired and that an Authorized Controller should have conducted the elections. The respondent further argued that the list of members used for the elections had not been registered as required by law, rendering the elections invalid.
The court meticulously analyzed the arguments presented by both parties, focusing on the provisions of the Scheme of Administration governing the institution. It noted that while the term of the Committee had indeed expired, the absence of an appointed Authorized Controller meant that the Committee was not prohibited from conducting elections. The court emphasized that the elections held by the petitioners could not be invalidated solely on the basis of the term expiration, especially since the elections were conducted in compliance with the previously accepted list of members.
Moreover, the court clarified that the requirement for the list of members to be registered under Section 4-B of the Societies Registration Act was not applicable in this case, as the list had been accepted prior to the amendment that introduced this requirement.
Ultimately, the Allahabad High Court quashed the orders of the Regional Level Committee that had rejected the elections held on January 2, 2022, and restored the order of the District Inspector of Schools, recognizing the petitioners as the legitimate managers of the institution. The court directed that the petitioners be handed over the charge of the institution within fifteen days, thereby affirming the validity of their management and the elections conducted.
This ruling underscores the importance of procedural adherence in educational institution management and clarifies the legal standing of elections conducted by Committees of Management in similar circumstances.
