Conversely, the BPSC maintained that it acted within its legal framework, stating that the recruitment process adhered to the Bihar State School Teacher (Appointment, Transfer, Disciplinary Proceeding and Service Conditions) Rules, 2023, which allowed for the rejection of candidates who did not meet the necessary qualifications.
The court examined the arguments presented by both parties, emphasizing the BPSC's duty to ensure that all vacancies are filled in accordance with the law. It noted that the BPSC had published a supplementary result for vacancies arising from candidates not joining due to multiple selections but failed to address vacancies created by ineligible candidates. The court found this selective approach unjustifiable, especially given the department's prior communication indicating a policy decision to fill all types of vacancies.
The court ruled in favor of the petitioners, directing the BPSC to identify and publish a supplementary merit list for the vacancies that arose due to candidates being found ineligible. This decision underscores the importance of transparency and fairness in public service recruitment processes, ensuring that all qualified candidates have the opportunity to be appointed as teachers.
