The court analyzed the timeline of events, noting that the application for the quarry lease was initially filed in 2010 but faced multiple rejections and delays. The court emphasized that the new Gujarat Minor Mineral Concession Rules of 2017, which came into effect on May 24, 2017, established a new framework for quarry leases, including a maximum duration of five years for leases executed after this date. The court referenced previous judgments that clarified that only leases granted or renewed before the new rules could be extended under the provisions of Rule 12.
Ultimately, the court dismissed the petition, affirming that the petitioner could not claim an extension of the quarry lease beyond the stipulated period as per the new rules. The ruling underscores the importance of adhering to the current legal framework governing mineral leases and the implications of regulatory changes on existing applications.
