judgement
Subject : Employment Law - Public Employment
In a significant ruling, the Gujarat High Court addressed the employment status of several Forest Guards who were appointed on a contractual basis. The case arose from a common judgment concerning multiple Letters Patent Appeals against a decision made by a Single Judge regarding the treatment of these employees as fresh appointees due to their failure to pass the Course of Computer Concepts (CCC) examination within the required timeframe.
The appellants, represented by the Assistant Government Pleader Mr. Sahil Trivedi, argued that the respondents should be treated as fresh appointees because they did not pass the CCC examination within the stipulated period. They contended that the respondents' seniority should be forfeited as per the provisions of the Government Resolution dated 23.10.2015, which mandated that employees who failed to clear the examination within two years of being placed in a regular pay scale would lose their seniority.
Conversely, the respondents, represented by senior advocate Mr.
The court analyzed the arguments presented by both sides and examined the relevant government resolutions and rules governing the employment of Forest Guards. It noted that the respondents had been regularized in their positions prior to the enactment of the new resolution and that the conditions of the 2015 resolution could not be applied retrospectively. The court emphasized that the respondents had valid CCC certificates and had cleared the examination again when required, thus their seniority should remain intact.
The court also highlighted that the actions taken by the appellants to treat the respondents as fresh appointees were arbitrary and lacked a legal basis, as there was no provision allowing such treatment after regularization.
Ultimately, the Gujarat High Court dismissed all Letters Patent Appeals, including the one filed by rival foresters, affirming the decision of the Single Judge. The court ruled that the actions of the appellants in treating the respondents as fresh appointees were illegal and arbitrary, thereby upholding the seniority of the Forest Guards. This ruling reinforces the importance of clear communication regarding employment requirements and the protection of employee rights within public service.
