The Petitioner, a federation of six Co-operative Housing Societies, sought to challenge the dismissal of their registration following an appeal by Respondent No. 2, a Developer. The Developer contested the registration, leading to the cancellation of the Petitioner’s status as a Federal Society, citing non-compliance with the Real Estate (Regulation and Development) Act ( RERA ).

The Petitioner argued that they had met the minimum requirement of five societies for registration as mandated by the Maharashtra Co-operative Societies Act. They contended that the registration was in line with the Flat Purchaser’s Agreement and that the Developer's concerns regarding the ongoing nature of the project were unfounded. The Petitioner maintained that the registration should not be hindered by the project's incomplete status.

Respondent’s Arguments

Conversely, the Developer argued that the registration was issued without proper adjudication and without notice to them. They emphasized that the formation of the Federal Society was premature as the project was still under development, and the obligations under RERA required the formation of an Apex Body only after the completion of the project.
