It found that the delays in project completion were not solely the contractor's fault, as they were influenced by external factors, including government actions. The court upheld the contractor's entitlement to price escalation under clause 32A of the contract, emphasizing that the contractor had sought extensions due to valid reasons. The court also dismissed the defendants' claims regarding excess payments, noting that the supplementary agreements had been negotiated fairly.
Ultimately, the court ruled in favor of the contractor, allowing him to recover Rs. 28,87,190 with interest at 6% per annum from the State of Kerala. The court dismissed the defendants' counter-claims, reinforcing the principle that public authorities should not rely on technicalities to evade legitimate claims. This decision underscores the importance of contractual fairness and accountability in public works projects.
