The original case, filed by Kumar 's wife, Renu Devi , sought financial support for herself and their minor son, Krish Kumar , following allegations of domestic abuse and neglect.

Following a brutal assault in 2017, she was forced to leave her matrimonial home with her son. Conversely, Kumar contended that he was a daily wage laborer with an annual income of only Rs. 72,000. He denied all allegations of abuse and claimed that Renu had deserted him. He argued that the maintenance order was unjustified and based on false claims.
