The appeals were filed by an insurance company challenging the compensation awarded by the Motor Accident Claims Tribunal (MACT) in Jodhpur. The claimants sought compensation under the Motor Vehicles Act, asserting that the accident was caused by the negligence of the driver of the offending vehicle, a truck-trolley.

The insurance company contended that the accident was due to the rash driving of the car's driver, who allegedly attempted to overtake another vehicle and collided with the stationary truck. They argued that the tribunal erred in attributing negligence to their insured driver based solely on the police's final report. The claimants were entitled to revised compensation amounts of Rs. 69,32,716, Rs. 33,69,430, and Rs. 68,40,572 for the respective deceased individuals, along with an interest rate of 9% from the date of filing their claims. This ruling underscores the importance of consistent evidence and the burden of proof in negligence cases related to motor vehicle accidents.
