The appeals were filed by an insurance company challenging the compensation awarded by the Motor Accident Claims Tribunal (MACT) in Jodhpur. The claimants sought compensation under the Motor Vehicles Act, asserting that the accident was caused by the negligence of the driver of the offending vehicle, a truck-trolley.
The insurance company contended that the accident was due to the rash driving of the car's driver, who allegedly attempted to overtake another vehicle and collided with the stationary truck. They argued that the tribunal erred in attributing negligence to their insured driver based solely on the police's final report. Conversely, the claimants maintained that the evidence, including the FIR and chargesheet against the truck driver, clearly established negligence on his part.
The court emphasized that the burden of proof regarding negligence lies with the claimants but operates on a standard of preponderance of probability. The tribunal had relied on the FIR and chargesheet, which indicated the truck driver’s culpability. The insurance company failed to produce any evidence to counter this claim, and their arguments were deemed inconsistent with their earlier statements. The court noted that the insurance company could not introduce new arguments at the appellate stage that contradicted their previous position.
The court partly allowed the appeals from the insurance company, modifying the compensation amounts awarded by the tribunal. The claimants were entitled to revised compensation amounts of Rs. 69,32,716, Rs. 33,69,430, and Rs. 68,40,572 for the respective deceased individuals, along with an interest rate of 9% from the date of filing their claims. This ruling underscores the importance of consistent evidence and the burden of proof in negligence cases related to motor vehicle accidents.
