Conversely, the employees contended that the government’s delay in making a decision was adversely affecting their careers, particularly regarding promotions that were contingent upon the retirement of their senior colleagues. They argued that the court should allow them to continue working until a decision was reached.
The court analyzed the arguments presented by both sides, emphasizing that the enhancement of retirement age is fundamentally a policy decision that lies within the government's purview. The judges noted that the employees could not claim benefits based on a future policy that had not yet been implemented. The court referenced previous judgments that established the principle that retirement age and related policies are determined by the government and cannot be mandated by the court.
The court also highlighted that the expert committee's recommendations would vary based on the specific circumstances of each PSU, making a uniform approach impractical.
Ultimately, the Kerala High Court ruled in favor of the State, setting aside the earlier judgments that permitted employees to continue in service beyond the stipulated retirement age. The court upheld the directive for the government to expedite the expert committee's report on the retirement age but clarified that until a formal decision is made, employees must adhere to the existing retirement age of 58 years.
This ruling underscores the principle that employment policies, particularly those concerning retirement, are within the government's discretion and cannot be claimed as rights by employees until officially enacted.
