Court Decision
Subject : Administrative Law - Public Employment
In a significant ruling, the High Court at Calcutta addressed four writ petitions filed by Sub-Assistant Engineers against the Kolkata Municipal Corporation (KMC). The petitioners challenged a circular issued by the KMC's 'Board of Administrators' that altered the recruitment regulations for promotions to the position of Assistant Engineer. The central legal question was whether the Board had the authority to modify these regulations, which the petitioners argued infringed upon their rights to promotion under the previous rules.
The petitioners contended that the KMC failed to initiate the promotion process despite existing vacancies, alleging that the delay was arbitrary and illegal. They argued that the circular dated July 22, 2022, which changed the promotion policy from 85% departmental promotions to 40%, was beyond the Board's authority and detrimental to their rights.
Conversely, the KMC defended the circular, asserting that the Board of Administrators was empowered to make such changes due to the extraordinary circumstances created by the COVID-19 pandemic. They argued that the modifications were necessary to ensure efficient municipal functioning during a time of crisis.
The court examined the scope of authority granted to the 'Board of Administrators' under the notification issued by the West Bengal government during the pandemic. It concluded that while the Board had the power to ensure essential services, it did not possess the authority to legislate or alter existing recruitment regulations. The court emphasized that the changes made by the Board were arbitrary and lacked a sound foundation, significantly impacting the rights of the petitioners.
The court also noted that the vacancies arose prior to the issuance of the new circular, and thus, the previous regulations should apply to those vacancies. The court referenced previous judgments to support the principle that changes in service conditions should not adversely affect employees without due process.
The High Court ruled in favor of the petitioners, setting aside the impugned circular dated July 22, 2022. The court directed the KMC to initiate the promotion process for eligible candidates based on the regulations that were in effect prior to the circular. This decision reinforces the importance of adhering to established recruitment policies and protecting the rights of employees within public service.
The ruling has significant implications for public employment practices in West Bengal, ensuring that changes to recruitment regulations are made within the bounds of legal authority and with consideration for the rights of existing employees.
