SUPREME COURT OF INDIA
J.S.Verma, CJI., M Jagannadha Rao, Sujata V Manohar, JJ.
DR. GEORGE MATHEW, PETITIONER
VERSUS
UNION OF INDIA, OTHERS, RESPONDENTS.
Writ Petition (C) No. 622 of 1995, decided on May 2, 1997.

The court held that a party seeking documents should be allowed to reply to a government's claim of privilege before the court decides on the matter. It also clarified that the pendency of a PIL does not prevent the government from acting on a committee report.

Headnote:(A) Administrative Law - Claim of privilege over documents - Production of documents sought by petitioner - Government claimed privilege - Petitioner contended that no application for privilege was made for documents referred to in a committee report and that such documents were not confidential - Court held that the petitioner should be allowed to file a reply to the affidavit claiming privilege before the question is decided. (Para 1)

(B) Public Interest Litigation (PIL) - Inaction of Government on committee report - Government not restrained from taking action despite pendency of matter in Court - Court observed that the matter was entertained as a PIL due to the inaction of the Government in taking necessary steps following a committee report. (Para 2)

Facts of the case:
The petitioner sought the production of certain documents, over which the government claimed privilege. The petitioner challenged this claim, asserting that the documents in a specific committee report were not confidential. Additionally, the petitioner raised concerns regarding the government's failure to act upon the recommendations of the said committee report, describing the government's response as unsatisfactory.

Findings of Court:
The court found it appropriate for the petitioner to file a reply to the affidavit claiming privilege. It also noted that the government had not been restrained from acting on the committee report and required further instructions on the actions taken or proposed.

Issues: Whether the petitioner should be permitted to file a reply to the claim of privilege and whether the government had taken sufficient action on the committee report.

Ratio Decidendi: When a claim of privilege is made regarding documents, the party seeking the documents should be given an opportunity to reply to the claim of privilege to ensure a fair hearing. Furthermore, the pendency of a PIL does not restrain the government from implementing the recommendations of a committee report.

Result: Affidavit on the question of privilege to be filed within four weeks; matter listed for 25-7-1997.

ORDER

1. On behalf of the Union of India privilege has been claimed in respect of certain documents the production of which was sought on behalf of the petitioner. The learned counsel for the petitioner submits that there is no application to claim privilege in respect of documents which are referred to in the report of the Gian Prakash Committee and at any rate the nature of those documents was not such as to require maintenance of any confidentiality, assuming the contents thereof are not yet widely known. The a learned counsel for the petitioner submits that in view of the claim for privilege it would be appropriate that the petitioner files a reply to the affidavit claiming privilege and that the question be then considered after hearing both sides on the point. We think that this is the appropriate course to adopt.

2. The learned counsel for the petitioner also submits that the learned Attorney General had on 17-2-1997 taken time to seek instructions to inform the Court of the action taken and proposed to be taken by the Government on the Gian Prakash Committee Report but no information to that effect is forthcoming and the additional affidavit on behalf of the Union of India of Shri Navin Kumar dated 25-4-1997 is quite unsatisfactory. We think that there is justification in the submission. It has been clear throughout that the Union of India was at no stage restrained from taking action on the Gian Prakash Committee Report notwithstanding the pendency of this matter in the Court and that this matter was required to be entertained as a PIL matter on account of the inaction of the Union of India to take the necessary steps consequent upon the report of the Gian Prakash Committee. In view of this, the learned Solicitor General wants some more time to seek instructions and to apprise the Court of the action taken or proposed to be taken by the Union of India on the Gian Prakash Committee Report.

3. Affidavit on behalf of the petitioner on the question of privilege be filed within four weeks. The matter be listed on 25-7-1997.
