1. All these appeals are directed against the common judgment of the High Court of Chhattisgarh at Bilaspur dated 01.12.2016 passed in Criminal Reference No. 1 of 2014 and Criminal Appeal No. 511 of 2014, as such they are disposed of by this common judgment and order.
2. All the appellants were charged for offence under Sections 364/34 read with 120B; 302/34 read with 120B and 201, Indian Penal Code (IPC). Vide judgment dated 27.03.2014 passed in Sessions Trial No. 61 of 2011, the learned Sessions Judge, Durg, has convicted and sentenced the appellants. For the offence under Sections 364/34 read with 120B, IPC they were convicted and sentenced for imprisonment for life and fine of Rs. 5000/- each in default of payment of fine, to undergo further rigorous imprisonment for four months. For the offence under Sections 302/34 read with 120B, IPC death penalty was imposed with a fine of Rs. 5000/- each in default of which, they were sentenced to undergo further rigorous imprisonment for four months.
