ORDER
I.A. NO. 45646/2022 IN. CONMT.PET.(C) 403/2021
1. Mr Naresh Kaushik, counsel appearing on behalf of the UPSC, states that on 30 November 2022, UPSC has issued a communication to the State of Jharkhand adverting to certain defects which were found in the proposal for recommending officers for the post of DGP.
2. We direct the State of Jharkhand to attend to the requisitions which have been furnished by UPSC and to positively submit its reply on or before 23 December 2022.
3. UPSC shall thereafter take consequential action no later than 9 January 2023.
4. List the IA on 16 January 2023.
W.P.(C) No. 1375/2021
1. Mr Naresh Kaushik, counsel appearing on behalf of UPSC, states that UPSC has prepared a panel for appointment of the DGP in the State of Bihar.
2. The panel which has been formulated by UPSC shall be communicated no later than by 19 December 2022, having due regard to the fact that the term of the incumbent is to expire on 19 December 2022.

Timely addressing of requisitions and taking consequential actions is crucial in the process of appointing officers for key positions.
A candidate must meet the established criteria and cut-off marks to be considered for appointment, and vacancies cannot provide an indefeasible right to appointment when the selection process is comp....
The main legal point established in the judgment is that when an alternative forum, such as the Central Administrative Tribunal, is available for redressal of grievances, the High Court may not enter....
The selected candidates did not have an absolute right to appointment, and the life of the panel remains valid for one year from the date of publication of the merit list.
Promotion to selection posts must be based on merit rather than seniority; the government is not obliged to promote an officer if deemed unsuitable.
Promotions in the Arunachal Pradesh Police Service take effect from the date of the promotion order, not from the date a vacancy arises, as per the Arunachal Pradesh Police Service Rules, 1989.
