Negotiable Instruments Act, 1881 – Section 138 – Criminal Procedure Code, 1973 – Section 482 – Dishonour of cheque – Criminal proceedings quashed by High Court – While considering prayer to quash criminal complaint and consequential proceedings at threshold, Court is required to examine whether allegations made in complaint along with materials in support thereof make out prima facie case to proceed against accused or not – In exceptional circumstances, Court may take notice of attending circumstances to conclude that continuance of proceedings would amount to abuse of process of Court, or where quashing of proceedings is necessary to secure ends of justice – In instant case, complaint clearly spells out necessary ingredients for commission of offence punishable under Section 138 of N.I. Act – It is also alleged in complaint that cheque was issued in discharge of liability qua goods supplied by complainant – Complainant had served notice of demand within specified period and despite service of notice of demand, no payment was made – Necessary ingredients of offence punishable under Section 138 of N.I. Act includes existence of a legally enforceable debt or liability – As fulfilment of necessary ingredients of Section 138 N.I. Act are prima facie made out from complaint allegations, neither summoning order nor complaint could have been quashed by High Court at pre-trial stage – Order of High Court set aside and criminal complaint restored on file of Magistrate. Facts of the case:
Present appeal impugns judgment and order of the High Court of Judicature at Patna1 dated 20.06.2019 in Criminal Miscellaneous No. 3744 of 2015 whereby, while exercising powers under Section 482 of the Code of Criminal Procedure, 19732, High Court quashed the entire criminal proceedings arising out of Complaint Case No. 1563(C) of 2013.
Findings of Court:
High Court committed error by conducting a roving enquiry, at pre-trial stage, as regards cheque being issued for discharge of debt or liability. Such an exercise was not merited in exercise of power under Section 482 of Code more so when complaint allegations disclosed that cheque was issued for discharge of liability.
Result : Appeal allowed.
प्रारंभिक चरण में शिकायत की जांच केवल तभी की जानी चाहिए जब उसमें स्पष्ट रूप से किसी भी आवश्यक तत्व का अभाव हो, जैसे कि यह सिद्ध हो कि चेक किसी ऋण या देयता की पूर्ति के लिए जारी नहीं किया गया था। शिकायत में यदि ये तत्व मौजूद हैं, तो मुकदमा शुरू करने का अधिकार न्यायालय का है और इसे बिना पूरी जाँच के रद्द नहीं किया जाना चाहिए (!) .
कानून यह मानता है कि जब चेक जारी किया जाता है, तो यह सामान्यतः ऋण या देयता की पूर्ति के लिए ही होता है, और यह presumption मुकदमे के दौरान ही खंडित की जा सकती है। इस presumption का आधार केवल शिकायत और उसके समर्थन में प्रस्तुत साक्ष्यों पर होता है, न कि प्रारंभिक चरण में निर्णय लेने पर (!) .
मुकदमा प्रारंभ करने के लिए, शिकायत में आवश्यक तत्वों का होना पर्याप्त है, और अदालत को यह नहीं देखना चाहिए कि चेक वास्तव में ऋण की पूर्ति के लिए जारी किया गया था या नहीं, क्योंकि यह परीक्षण का विषय है जो मुकदमे में ही किया जाएगा। प्रारंभिक चरण में इस पर निर्णय लेना न्यायसंगत नहीं है (!) .
मुकदमे को रद्द करने का निर्णय, विशेष रूप से प्रारंभिक चरण में, मुकदमे की प्रक्रिया को अवरुद्ध कर सकता है और न्यायालय के उचित परीक्षण का अवसर नहीं दे सकता। इससे पक्षों को अपने-अपने बचाव का मौका नहीं मिल पाता और न्याय प्रक्रिया प्रभावित हो सकती है (!) .
न्यायालय को यह भी ध्यान में रखना चाहिए कि, मुकदमे को प्रारंभिक चरण में ही रद्द करने से, आरोपी को अनावश्यक लाभ मिल सकता है क्योंकि वह अपने बचाव का अवसर नहीं पा सकता। इसलिए, मुकदमे को शुरू करने और मामले की पूरी जाँच करने का अवसर देना अधिक उचित है (!) .
इस निर्णय का उद्देश्य यह सुनिश्चित करना है कि मुकदमे की प्रक्रिया उचित तरीके से पूरी हो और दोनों पक्षों को न्याय का अवसर मिले। प्रारंभिक चरण में ही मुकदमे को रद्द करना न्यायसंगत नहीं है, जब तक कि शिकायत में कोई स्पष्ट और गंभीर खामी न हो (!) .
इस निर्णय के माध्यम से यह भी स्पष्ट किया गया है कि, अदालत का कार्य केवल शिकायत में उपस्थित तथ्यों और शिकायत में उल्लिखित आवश्यक तत्वों की जाँच करना है, न कि मामले की सच्चाई का परीक्षण करना। यह परीक्षण मुकदमे के दौरान ही किया जाएगा (!) .

1. Leave granted.
2. This appeal impugns judgment and order of the High Court of Judicature at Patna1 [The High Court] dated 20.06.2019 in Criminal Miscellaneous No. 3744 of 2015 whereby, while exercising powers under Section 482 of the Code of Criminal Procedure, 19732 [The Code] High Court quashed the entire criminal proceedings arising out of Complaint Case No. 1563(C) of 2013.
3. Briefly stated, the facts giving rise to the appeal are that the appellant lodged a complaint under Section 138 of the Negotiable Instruments Act, 18813 [N.I. Act] against the first respondent by alleging, inter alia, that the first respondent took delivery of goods from the complainant and in lieu thereof issued cheque, dated 04.03.2013, of Rs. 20,00,000. On 04.03.2013 itself, the complainant presented the said cheque with its banker for collection. However, the same was returned unpaid on 11.03.2013 with a remark of insufficient funds in the drawer’s account. The complainant thereafter met the first respondent on 12.03.2013 who assured that if the cheque is presented after a week, it will be honored. In consequence, cheque was re-presented on 17.03.2013 but it was again returned unpaid on 18.03.2013, with same remark. As a result, on 02.04.2013 a legal notice of demand was sent to the first respondent. In its reply dated 08.04.2013, the first respondent denied having issued the cheque and refused to make payment. Since payment was not made within the stipulated period, the complaint was filed.
4. The learned Magistrate took cognizance on the complaint and vide order dated 27.09.2013 summoned the first respondent under Section 138 of N.I. Act. Aggrieved by the summoning order dated 27.09.2013, the first respondent filed an application (i.e. Criminal Miscellaneous No. 3744 of 2015), under Section 482 of the Code, before the High Court.
5. By the impugned order dated 20.06.2019, the High Court quashed the complaint proceedings, inter alia, on the ground that the cheque was not issued for the discharge, in whole or in part, of any debt or other liability.
6. Aggrieved by the impugned order, the complainant has filed this appeal.
7. We have heard learned counsel for the parties and have perused the materials available on record.

In short, the submission on behalf of the appellant is that the High Court exceeded its jurisdiction under Section 482 of the Code by holding an enquiry as to whether the cheque in question was for the discharge, in whole or in part, of any debt or other liability inasmuch as under Section 139 of the N.I. Act a presumption is raised, unless the contrary is proved, that the holder of a cheque received the cheque of the nature referred to in Section 138 for the discharge, in whole or in part, of any debt or other liability. Though this presumption is rebuttable, such presumption can only be rebutted in trial and therefore, the complaint which encapsulates all the essential ingredients of an offence punishable under Section 138 of N.I. Act could not have been quashed at the threshold by examining whether the cheque concerned was received by the holder of the cheque for the discharge, in whole or in part, of any debt or other liability.

Per contra, the learned counsel for the first respondent submitted that the complaint was mala fide and therefore, the High Court was well within its jurisdiction to consider whether the cheque had been issued for the discharge, in whole or in part, of any debt or other liability. It was argued that once the High Court has recorded a finding that the cheque was not issued for the discharge, in whole or in part, of any debt or other liability, no interference with the order of the High Court is called for.
10. We have considered the rival submissions and have perused the materials on record.
