Shalimar Biscuits Pvt. Ltd. – Respondent


( 1 ) ALL these appeals arise under the Employees Provident Funds and Family Pension Fund Act (Act 19 of 1952 ). The Employees provident Fund Inspector, Andhra Pradesh filed CC. Nos. 278, 279 and 281 to 284 of 1975 against the four accused (A-1 to A-4 ). A-1 is M/s. Shalimar biscuits Limited, Industrial Estates, Uppal, Hyderabad; A-2 is B. N. Patel, the Managing Director of the Company, A-3 is C. B. Patel. A-3 and A-4 are the Directors of the Company. As A-2 went abroad the case against, him was separated.

( 2 ) C C. No. 278/1975 was filed against the above accused alleging that they failed to deposit the Employers share of the Provident Fund of the employees Rs. 4,422/- for the month of April, 1973, Rs. 4,562/- for the month of May, 1973 and Rs. 4,478/- for the month of June, 1973 and hence the accused contravened the provisions of para 76 (a) of the employees Provident Fund Scheme read with Section 14 (1 -A), 14 -AA and 14 (2) of the Employees Provident Fund Act.

( 3 ) C C. No. 279/75 was filed with the allegation that the accused failed to deposit the employers share of provident fund of the Employees in a sum of Rs. 3,926/- for the month of May, 1974, Rs. 4,105. 50 ps for
