JUDGMENT
V.Srishananda, J. - Learned High Court Government Pleader has filed memo enclosing latest Medical Reports.
2. Heard Sri.Shankarappa, learned counsel for petitioner and learned High Court Government Pleader.
3. This Court considering the request of the petitioner for grant of bail under Section 439 of Cr.P.C. earlier and looking at the merits of the matter, was not inclined to grant bail to the petitioner. Later on, petitioner has suffered serious ill health and after evaluation of his health conditions, the prison authorities at Hassan decided to shift him to Victoria Hospital, Bengaluru for treatment. Latest medical reports disclose that his health is no doubt stabilized but he has lost weight to the extent of 13 kgs within a short span of time.
4. Thus, without expressing any opinion on the merits of the matter, in order to have further stability with regard to his health, this Court is inclined to grant bail to the petitioner initially for a period of three months to be re-evaluated later. Accordingly, I pass the following:
ORDER
(i) Criminal Petition is allowed in part.
(ii) The petitioner is directed to be enlarged on bail in C.C.No.125/2022 (Cr.No.66/2021) of Balur Police S
