Headnote:Criminal Procedure Code, 1973 - Section 313 - Examination of accused - Recording of statement of accused made under Section 313 of Code - Court, can examine accused personally to explain any circumstance appearing in evidence against him - Statement can be recorded without previously warning accused or with due notice to him - It is mandatory requirement of Section 313 of Code. - It is settled position in law that while complying with the mandatory requirement of Section 313, the Court is not expected to put every material to the accused. It has to be confined to the circumstances appearing in the substantial evidence, which, in the opinion of the Court, require explanation by the accused.
