The above three Criminal Revision applications arise out of the common judgment and order dated 16.04.2016, passed in RC No.25A/1997 by learned Special Judicial Magistrate, C.B.I.-II, Patna, whereby she has rejected the petition filed under Section 239 of the Cr. P.C. on behalf of the petitioners for their discharge. The said RC 25A/1997 has been registered by the C.B.I. for the offences punishable under Sections 409, 420, 467, 468 and 120B of the IPC and Section 13(2) read with Section 13(1) (D) of the Prevention of Corruption Act.
2. I have heard Mr. Abhay Kumar Singh, learned Senior Counsel appearing on behalf of the petitioners and Mr. Bipin Kumar Sinha, learned counsel for the Central Bureau of Investigation (hereinafter referred to as the “C.B.I.”).
3. Before I take up the ground for challenge to the impugned order, there are certain facts which are to be taken note of.
4. On an information given by the then Executive Engineer, Road Construction Department, Bhagalpur (West), a case was registered by the Sultanganj Police Station as Sultanganj P.S. Case No. 186/1996 against one Anandi Prasad Amit, Junior Engineer, alleging that he had verified the stock position of bulk
