Appellant Sanjay Kumar Gupta has been found guilty for an offence punishable under Section 304B of the I.P.C. and sentenced to undergo S.I. for nine years, under Section 498A of the I.P.C. and sentenced to undergo S.I. for two years, under Section 323 of the I.P.C. and sentenced to undergo S.I. for 15 days, under Section 3 of the D.P. Act and sentenced to undergo S.I. for three months as well as to pay fine appertaining to Rs.3,000/- and in default thereof, to undergo S.I. for three months, additionally, under Section 4 of the D.P. Act and sentenced to undergo S.I. for three months as well as to pay fine appertaining to Rs.3,000/- and in default thereof, to undergo S.I. for three months, additionally, with a further direction to run the sentences concurrently, with a further direction that the period having undergone during course of trial will be subject to set off in accordance with Section 428 of the Cr.P.C. vide judgment of conviction dated 31.08.2015 and order of sentence dated 03.09.2015 passed by the Additional Sessions Judge-4 th, Gaya in Sessions Trial No.544 of 2010/29 of 2015.
