Three appellants in Cr.Appeal (DB) No. 23 of 2014 and sole appellant in Cr.Appeal (DB) No. 144 of 2014 were tried together and convicted and sentenced by the common judgment of the trial court and as such, both the appeals were taken-up together under the heading "For Hearing" and are being disposed of by this common judgment. Appellants against the judgment of conviction and sentence have approached this Court by filing the aforesaid appeals under Section 374(2) of the Code of Criminal Procedure, 1973 (hereinafter referred to as "Cr.P.C.").
2. All the appellants in both the appeals by judgment dated 12-12-2013 have been convicted for commission of offence under Sections 302/34, 307/34, 326/34, 448 of the Indian Penal Code, 1860 (hereinafter referred to as 'I.P.C.'), however; the sole appellant i.e. Md. Hasim @ Akla {in Cr.Appeal (DB) No. 144/14) by the same judgment was further convicted for offence under Sections 3 and 4 of the Explosive Substances Act, 1908 (hereinafter referred to as 'Explosive Substances Act').
