Heard I.A. No. 01 of 2019 for condonation of delay. There is a delay of about 78 days in filing L.P.A. No. 737 of 2019. For the reasons stated in the application read with the affidavit, delay of about 78 days in filing L.P.A. No. 737 of 2019 stands condoned.
2. Accordingly, I.A. No. 01 of 2019 stands allowed.
3. With the consent of the learned counsels for the respective parties, L.P.A. No. 737 of 2019 is taken up for final disposal.
4. Appellant has assailed the order of the learned Single Judge dated 05.03.2019 passed in C.W.J.C. No. 5707 of 2015. Core issue involved in the present lis is whether appellant is entitled to be transferred/shifted to Collectorate Establishment under the State Government of Bihar from District Rural Development Authority (for short DRDA). Among others, Appellant was working in DRDA. State Government took a policy decision on 27.07.2009 insofar as considering such of those employees in DRDA to be shifted to the Collectorate Establishment under the State Government of Bihar. Order dated 27.07.2009, Annexure-2 to the Writ petition reads as under:
