JUDGMENT :
1. This appeal has been preferred by the appellant under Section 374 (2) of the Code of Criminal Procedure, 1973 against judgment dated 30.06.1999 passed by Special Judge, Raipur, District- Raipur (C.G.) in Special Criminal Case No. 49/91, whereby the appellant stands convicted and sentenced as under:-

The case of the prosecution, in brief, is that on 26.09.1986, the appellant, who was posted as an Assistant Security Inspector with the then Madhya Pradesh State Road Transport Corporation (MPSRTC) Korba and a public servant. The complainant- Bholaram was posted as Conductor and carrying the bus at Balco-Korba bus route. The bus was checked near Madwarani Temple by the appellant along with another
