1. The facts and issues raised in the aforesaid matters are broadly same. For the purpose of this judgment, I am confining myself to the facts of the first suit, namely, I.A. No. 2701/2021 in C.S. (COMM) No. 90/2021 titled as Super Cassettes Industries Pvt. Ltd. vs. Music Broadcast Limited.

2. I.A. No. 2701/2021 is an application under Order 39 Rules 1 and 2 CPC seeking an ex-parte injunction to restrain the defendant, its directors, employees, etc. from broadcasting/communicating to the public and otherwise exploiting the plaintiff's copyright works through the defendant's FM Radio channels/stations and infringing the plaintiff's copyright works.
