Dinesh Kumar Sharma, J.
Mahaveer Prasad Saini - Appellant
Versus
State - Respondent
W.P.(Crl.) 2840 of 2022
Decided On : 29-11-2022

The consent of the complainant in a resolved matrimonial dispute can lead to the quashing of an FIR under IPC Section 354, as seen in cases where reconciliation is achieved.

Headnote:(A) Indian Penal Code, 1860 - Section 354 - Quashing of FIR seeking relief in relation to a matrimonial dispute - Petition filed to quash FIR No. 38/2021, which emerged from a matrimonial conflict, following a Settlement Agreement. The complainant, being a student, does not wish to pursue the case any further, leading to the FIR's quashing based on her voluntary statement and the absence of coercion. (Paras 2, 3, 4, 6)

(B) Consent of Complainant - The consent of the complainant is pivotal in determining whether to proceed with an FIR, especially in disputes of a matrimonial nature where reconciliation has been achieved. (Paras 4, 5)

Facts of the case:
The petition concerns an FIR registered under IPC Section 354 relating to a matrimonial dispute that has since been settled through a Mediation Agreement. The complainant, a BDS student, has expressed her desire not to pursue the FIR following this settlement.

Findings of Court:
After considering the statements of the complainant and the context of the settlement, the court quashed the FIR, emphasizing that the complainant had no objection to this course of action.

Issues: The primary issue addressed was the impact of a resolved matrimonial dispute on the continuation of a serious criminal charge.

Ratio Decidendi: The court held that when a matrimonial dispute is resolved amicably, and the complainant expresses disinterest in pursuing the FIR, it is appropriate to quash the FIR, as the consent of the complainant is crucial for the proceedings to continue legitimately.

Result: FIR No. 38/2021 is quashed and the petition disposed of.
