JUDGMENT

Palok Basu, President — Swami Vivekanand, the religio-social charioteer of modern India desperately worked and prayed for upliftment of India and if one is asked to condense Swamiji’s varied sermons to attain that objective in one expression, “Man making Education” is the only available conclusion. Who can deny the reality that principal reason for backwardness of our Nation has been lack of education to the citizens. Therefore, when the forefathers of the Constitution of India incorporated Article 21 — No person shall be deprived of his life or personal liberty except according to procedure established by law” beckoned the widest interpretation by the Supreme Court that “The right to live with human dignity with minimum sustenance and shelter and all those rights and aspects of life which would go to make a man’s life complete and worth living, would form part of the right to life” (Samatha v. State of A.P.1. Undoubtedly, to get education is a fundamental right of a citizen of India though it is unfortunate that in large areas of our mother land still illiteracy rules.

2. It needs no repetition that law enacted by Parliament or State legislature, which guides institutions
