JUDGMENT

T.M. Hassan Pillai, President—Sri P.V. Balasubramaniam who is a senior member of the Thiruvananthapuram Bar and respected by the members of the bar had to approach the CDRF, Thiruvananthapuram for redressal of his grievance by filing a complaint before that forum as OP. 611/98 as he was aggrieved by the demand made by the appellant herein(Housing Board) for Rs. 43,382/- asserting that the actual area of plot No. 26 allotted to him is 237m2 and he was liable to remit enhanced land value of plot No. 26 awarded to the previous land owner by court in land acquisition reference and payable by the appellant to the previous land owner. Demand made included interest, penal interest and expenses incurred in contesting the claim made by the previous owner in the land acquisition reference made to court. His stand was that he was not liable to pay the amount demanded by the appellant as per Ext. P9(Rs.43,382/-) on the ground that he had already remitted the cost of the plot allotted to him(remitted Rs. 58,610/-) and the actual extent of the plot allotted to him is only 217.64 sq. metres.
