JUDGMENT
AVM J. Rajendra, AVSM VSM (Retd.), Member—This Appeal is filed under section 19 of the Consumer Protection Act, 1986 (“the Act’), against the State Consumer Disputes Redressal Commission, Maharashtra (“State Commission’) Order dated 09.10.2015 in CC No.06 of 2003 dismissing the complaint.
2. As per the Registry report, there is a delay of 40 days in filing the present Appeal and in the interest of justice, the delay is condoned.
3. Brief facts of the case, as per the complainant, are that he is in the jewelry business with office at 34/2, Tarun Bharat Society, Opp. Hotel Sresha, Chakala, Andheri (East), Mumbai-400 099. Towards safe guarding the goods in the custody of the Complainant in the showroom as well as while in transit, the Complainant had obtained the Jewelers Block Insurance Policy No.110902/46/99/00461 from OP-1/ Insurer from 04.02.2000 to 03.02.2001 for total sum insured of Rs.43,00,000. It is the contention of the Complainant that a robbery took place to the showroom on 18.07.2000 at about 13:45 PM. The intimation and information was furnished to Police Station as well as OP-1 and 2 on the same day. In the robbery the Complainant lost gold ornaments worth Rs.3
