( 1 ) THIS appeal, which is filed under Sec. 374 (2) of the Code of criminal Procedure, 1973, is directed against the judgment and order dated december 21, 2001, rendered by the learned Additional City Sessions Judge. Court no. 7. Ahmedabad City, in Sessions Case No. 115/2001, by which the appellant is convicted under Sec. 17 and Sec. 18 of the Narcotic Drugs and Psychotropic Substances act, 1985 ("the NDPS Act" for short) and punished with R. I. for 10 years and fine of rs. 1,00,000/- (Rupees One Lac) i/d. R. I. for one year for the offence punishable under Sec. 17 of the NDPS Act as well as R. I. for 10 years and fine of Rs. 1,00,000/- (Rupees One lac) i/d. R. I. for one year for the offence punishable under Sec. 18 of the NDPS Act. We may state that learned Judge has not directed that the punishments imposed on the appellant shall run concurrently and, therefore, in view of the provisions of Sec. 31 of the Code of Criminal Procedure, 1973, the effect of imposition of punishment of imprisonment is that the punishments consisting of imprisonment will commence one after the expiration of the other.
