1. In all 10 (ten) accused/Appellants above named were put on trial, in Sessions Case No. 48 of 2004, for commission of offence under Sections 147/148/323/324/341/302/149 IPC. On the conclusion of trial the learned Addl. Sessions Judge (FTC), Barpeta, by his judgment and order, dated 29.08.2007, convicted accused/Appellants No. 1 and No. 2 under Sections302/149/341/147/148 IPC and sentenced each of them to undergo rigorous imprisonment for life with fine of Rs. 2,000/- each, in default to undergo further rigorous imprisonment for two (2) months each, for commission of offence under Sections 302/149 IPC. However, no separate sentences were imposed on the Appellant Nos. 1 and 2, for commission of other offences.
2. By the same judgment and order, the learned trial Court convicted the Appellants Nos. 3, 4, 5, 6, 7, 8, 9 and 10 under Sections 147/148/323/149 IPC and sentenced them to undergo rigorous imprisonment for one (1) year, for offence under Sections 147/148 IPC and for two (2) months each for commission of offence under Section 323/149 IPC.
