Heard Mr. K Goswami, learned counsel appearing on behalf of the petitioner. Also heard Mr. J Roy, learned counsel appearing on behalf of the respondents No. 1 to 7 and Mr. K. Patgiri, learned counsel appearing on behalf of the private respondent No. 8.

In this writ petition, work order dated 15.06.2017 issued by the Numaligarh Refinery Limited (NRL), respondent No. 1 to the respondent No. 8 in terms of Tender No. OC27000019/PRA dated 20.04.2017 for hiring of an Ambulance with facilities of critical care is challenged as the respondent No. 8 is not technically qualified as per the terms and conditions of the tender document.

The Numaligarh Refinery Ltd., the respondent No. 1 on 20.04.2017 issued E-tender vide Notice Inviting Tender (NIT) under Tender No. OC27000019/PRA dated 20.04.2017 for ‘hiring of ambulance with facilities of critical care’.
