WP(C)/9305/2019
Decided On : 27-02-2025
(A) Assam Local Fund Audit Service Rules, 1995 - Rule 17 and Rule 20(3) - Promotion of Audit Officers - Petitioners, serving in the Audit Branch, challenged promotions based on a select list that expired after 12 months. Court held that no further promotions could be made based on the expired list. (Paras 12 , 14 )
(B) Writ Jurisdiction - Scope - The court noted that the validity of the select list had lapsed, thus no further promotions could be made under it. The pending challenge to Rule 20(3) did not affect this conclusion. (Paras 14 , 15 )
Facts of the case:
Petitioners sought to restrain promotions beyond the advertised vacancies of Audit Officers, arguing the select list had lost validity after 12 months. The APSC had initially advertised 32 vacancies but created a merit list of 57 candidates.
Findings of Court:
The court found that the select list dated 07/11/2019 had lost its validity after 12 months, thus promotions could not be made based on it.
Issues: The main issues were the validity of the select list and the implications of Rule 20(3) on promotions.
Ratio Decidendi: The court ruled that the select list was invalid after 12 months from the APSC's approval, affirming that no promotions could occur based on it beyond this period.
Result: Writ petitions disposed of accordingly.

Accordingly, the Assam Public Service Commission (APSC) had issued an advertisement notice dated 03/05/2018 inviting applications for the Assam Local Fund Audit Service (Promotion) Examination for filling up 32 numbers of vacant posts of Audit Officer (Local Fund). The 32 vacancies of Audit Officers, so advertised, included 3 posts reserved for the ST(P) category and 4 posts for the ST(H) category, thus, leaving 25 posts for the general category.

On the same day i.e. 07/11/2019, the APSC had also forwarded the names of 14 candidates who had secured exemption marks in one or more subjects.
