JUDGMENT

Vinit Kumar Mathur, J. - The present second bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner who is in custody in connection with F.I.R. No.121/2019, Sarwana Police Station, District Jalore, for the offence under Sections 324, 332, 333, 353, 307/34 of IPC.

2. Heard. Perused the material available on record.

3. After the rejection of the first bail application of the petitioner on 21.07.2020, the co-accused Suresh Kumar has been enlarged on bail by a Coordinate Bench of this Court vide order dated 10.01.2023. He submits that the case of the present petitioner is not distinguishable from the case of the co-accused who has already been enlarged on bail by a Coordinate Bench of this Court. He, therefore, prays that the petitioner may be enlarged on bail.

4. Learned Public Prosecutor has opposed the bail application but he is unable to distinguish the case of the present petitioner vis-a-vis the case of the co-accused person who has been enlarged on bail.
