IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR
MANINDRA MOHAN SHRIVASTAVA, C.J., MUNNURI LAXMAN, J.
Shravan Singh S/o Shri Abhay Singh - Appellant
Versus
State Of Rajasthan - Respondent
D.B. Civil Writ Petition No. 745/2023
Decided on : 18-03-2025
(A) Rajasthan Civil Services (Absorption of Ex-Servicemen) Rules, 1988 - Constitutional validity of sub-rule (3) of Rule 2 challenged - Petitioners, ex-servicemen, contest category-wise reservation for direct recruitment - Court finds no violation of constitutional provisions or Supreme Court precedents - Amendment aligns with legal requirements and does not frustrate representation objectives. (Paras 2, 5, 12, 20)
(B) Reservation Principles - Horizontal reservation permissible for ex-servicemen across categories - Court emphasizes merit-based selection and representation for marginalized groups - Category-wise reservation does not negate merit. (Paras 6, 18, 21)
Facts of the case:
Petitioners challenge the amendment to the Rules of 1988, arguing it undermines the objective of adequate representation for ex-servicemen in public employment. The amendment allows category-wise reservation, which petitioners claim reduces their chances.
Findings of Court:
The court upheld the amendment, stating it complies with legal requirements and does not violate any constitutional provisions.
Issues: The main issues were whether category-wise reservation for ex-servicemen is permissible and whether it undermines their representation in public employment.
Ratio Decidendi: The court ruled that horizontal reservation is valid and does not negate merit, emphasizing that the amendment aligns with Supreme Court principles regarding reservation.
Result: Petition dismissed.

Reservation policies must not exceed 50% of total vacancies and should be applied in alignment with horizontal and vertical reservation principles without creating inequalities.
Ex-servicemen reservation is overall horizontal, applied across vertical categories post-merit lists; recruitment terms fixed at advertisement cannot be altered by subsequent prospective instructions....
Ex-servicemen who avail age relaxation cannot demand consideration in unreserved vacancies regardless of merit, as it contravenes governing recruitment rules.
Candidates participating in selection processes cannot later challenge recruitment methodologies after being declared unsuccessful, unless they timely contest relevant notifications.
