Present appeal is filed against the judgment of acquittal passed by learned Sessions Judge Chamba in Sessions trial No. 40 of 2010 titled State of H.P. vs. Tilak Raj.
BRIEF FACTS OF THE PROSECUTION CASE:
2. Brief facts of the case as alleged by prosecution are that on dated 1.1.2010 at Karian within the jurisdiction of Police Station Chamba during night time accused committed rape upon prosecutrix without her consent and on the aforesaid date time and place accused threatened the prosecutrix to kill her. It is alleged by prosecution that accused also physically assaulted the prosecutrix and also slapped her and also twisted her arms. It is alleged by prosecution that thereafter accused asked the prosecutrix to attend the office and accused also told the prosecutrix that in the meantime accused would return from Mehla after obtaining money and thereafter he would take the prosecutrix along with him to his home.
