JUDGMENT :

Aggrieved by the dismissal of the appeal against the levy of VAT @ 13.75%, as against the claim of 5%, the petitioner has filed the instant petition.
2. The revision petition came to be admitted by this Court on 19.07.2017, on the following substantial questions of law:-
“(a) Whether the H.P. Tax Tribunal, Dharamshala, camp at Shimla, has erred in law in not appreciating thatmechanical bodies and pre-fab shelters, sheets, metals, parts etc. is capital goods and taxable @ 5%?
(b) Whether the H.P. Tax Tribunal, Dharamshala, camp at Shimla, has erred in law in not appreciating that once good falls under any of Harmonized System of Nomenclature (HSN) classification, the residuary entry is not applicable ?
(c) Whether the H.P. Tax Tribunal, Dharamshala, camp at Shimla has erred in law in not appreciating that the order passed by the Authorities regarding levy of penalty is totally against the basic principles of interpretation of provision of Act and law as the taxability is totally based on issue of interpretation.”

Goods must be accurately classified under VAT provisions; misclassification can lead to penalties.
Point of Law : Question of manufacture is not relevant for the purposes of the 2003 Act.
Tax exemption for HDPE woven fabrics requires actual levy of additional duty; nil rate does not equate to exemption under sales tax law.
Service tax collected must be included in the sale price for VAT under the VAT Act, with no constitutional grounds for challenge against the relevant provisions.
The central legal point established in the judgment is the classification of 'idler' as a component part of machinery and its exigibility to tax at the first point of sale.
