Headnote:(A) Service Rules - Himachal Pradesh Medical Education (Dental) Service Rules, 2006 - Post of Lecturer - 50% by promotion from Medical Officers (Dental) possessing qualifications and three years service - Rules scrapped by 2009 Tenure Policy, proposed for rescission per affidavit before Supreme Court - Post pertaining to reserved category with requisition for direct recruitment pending since 2015 - Inadvertent initiation of promotion process via calling service particulars from 2010 withdrawn - Challenges to communications, eligibility years, exclusion/inclusion, and withdrawal infructuous or ineligible as claimants not entitled to reserved post - State directed to finalize Recruitment and Promotion Rules within four weeks and initiate process per rules and roster. Facts of the case:
Multiple writ petitions by Medical Officers (Dental) challenging letter calling eligible candidates' particulars year-wise from 2010 for promotion to Lecturer post, exclusion from shortlist, claim for earlier eligibility year treating contractual service as ad hoc, and withdrawal of process; one seeking completion of promotion via Departmental Promotion Committee. Respondents averred promotion process inadvertent as post under reserved category requisitioned for direct recruitment, insisting on rules amendment first.

Findings of Court:
All writ petitions dismissed. Respondent-State directed to finalize Recruitment and Promotion Rules within four weeks, then initiate selection process as per rules and applicable reservation roster.

Issues: Whether vacancy for 2010 to be filled by promotion strictly per rules and seniority or direct recruitment for reserved category; validity of withdrawing inadvertent promotion process; treatment of contractual service for eligibility year.

Ratio Decidendi: Post held on tenure basis categorized as reserved, to be filled by direct recruitment per pending requisition; promotion claims untenable for non-reserved candidates; no extant rules post 2009 scrapping necessitates finalization per Supreme Court directions before proceeding; earlier petitions infructuous post withdrawal.
