1. The instant criminal miscellaneous petition has been filed under Section 482 of the Cr.P.C . for quashing the entire criminal proceeding including order dated 30.01.2019, whereby cognizance for the offence punishable under Section 498(A), 504 read with Section 34 of the I.P.C. and Section 4 of Dowry Prohibition Act has been taken by the learned Judicial Magistrate, 1st Class, Jamshedpur.
2. Learned counsel for the petitioners has submitted that there is a matrimonial dispute amongst the parties. Petitioner no.1 is the husband of the opposite party no. 2, Petitioner no.2 is the mother-in-law, who is very old lady aged about 66 years and the Petitioner no.3 is a married lady and Sister-in-law of the opposite party no.2 (Complainant).
3. It is further submitted that admittedly the opposite party no.2 is the legally wedded wife of the petitioner no.1. However, from perusal of the complaint petition and solemn affirmation, it appears that all the allegations are general in nature and there is no specific and direct allegation against anybody.
