JUDGMENT :

1. The order of rejection dated 27.05.2010 issued by the respondents, in respect of the claim of the writ petitioner, seeking compassionate appointment is under challenge in this writ petition.

2. The learned Counsel appearing for the petitioner made submissions that the husband of the writ petitioner Late Shri L. Gopi was employed as a part time employee on contract basis for consolidated pay and passed away on 11.04.2000, while he was in service. However, the claim of the writ petitioner seeking compassionate appointment was rejected on the ground that the post of Makkal Nala Paniyalar has to be filled up in accordance with the Rules in force and seeking compassionate appointment is not applicable to the said post.

3. May that it be, it is brought to the notice of this Court the counter filed by the second respondent, wherein it is stated that Late Mr.Gopi was appointed as a Makkal Nala Paniyalar on 16.06.1990 in Kulapuram Village Panchayat, Munchirai Panchayt Union, Kanniyakumari District by the District Collector, Kanyakumari as per G.O.Ms.No.496, Rural Development Department dated 02.09.1989 as a part time employee on contract basis and the honorarium of Rs.200/- per m
