The inclusion of the petitioners' names in the regular panel of the year 2014-2015 and their selection for the post of Forest Range Officer was considered conclusive, and no further consideration was required.

JUDGMENT

(Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, calling for the records of the first respondent proceedings NO.B2/16762/2013-3 dated 29.05.2014, to quash the same and issue consequential direction to the respondents to allow the petitioner to continue as Forest Range Officer.

Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to forthwith process the pension proposals of the petitioner and to peacefully retire him from service in the post of Forest Range Officer on 31.07.2015 AN, notwithstanding and without reference to the pendency of W.P.No.14573/2014 in the absence of any other impediment and to grant him all consequential retirement and pensionary benefits.)

Common Order

1. When these matters were listed for hearing on 22.07.2022, none appeared on behalf of the petitioners. Thus, this Court passed an order, directing the Registry to list these matters on 26.07.2022 under the caption “For Dismissal”.

2. Even today i.e., on 26.07.2022, when these matters are called, there is no representation on behalf of the writ petitioners. Thus, the arguments of the learned Special Government Pleader was considered and the following orders are passed.

3. The learned Special Government Pleader appearing on behalf of the respondents relying on the written instructions given by the Principal Chief Conservator of Forests in letter dated 22.07.2022, made a submission that the petitioners were temporarily promoted as Forester and further, promoted as Forest Range Officer temporarily under Rule 39(a)(i) of Tamil Nadu State and Subordinate Service Rules.

4. The petitioners were informed that in the selection for the post of Forest Range Officer their names have been declared as ''Not Selected'' and thus, the petitioner was reverted back to the post of Forester.

5. Again the regular panel of the year 2014-2015 was prepared with a crucial date 15.08.2014, the names of the petitioners were included and their names have been declared as ''Selected''.

6. In view of the fact that the petitioners were considered in the panel of the year 2014-2015, no further consideration is required in respect of the grounds raised in these writ petitions.

7. Thus, these writ petitions stand dismissed. No costs. Consequently, connected Miscellaneous Peititon is closed.
