1. On being named by the main accused in his custodial interrogation as the seller of the contraband, the petitioner, apprehending arrest for violating the above-mentioned provisions of Narcotics Drugs and Psychotropic Substances Act, 1985 (NDPS Act) per the FIR captioned above had come up before this Court under Section 438 CrPC seeking anticipatory bail.

2. In paragraph 6 of the bail petition, the accused declares that he has no criminal antecedents.

3. Briefly stated, as per the case of the prosecution, on 20.10.2020, the police party, which was on patrol duty, noticed a Toyota Corolla car parked in suspicious manner and its window glasses were closed. The police party after opening the car conducted its search and found three plastic bags in the dickey and two plastic bags in the back seat, which contained a total of 97 kgs. Poppy husk and accordingly, the above captioned FIR was registered against unknown person.

4. Ld. Counsel for the petitioner contends that the petitioner has been nominated on the basis of the disclosure statement of the main accused, and such state
