The prayer in the present petition under Section 439 Cr.P.C. is for the grant of regular bail in case bearing FIR No.58 dated 17.05.2021 (Annexure P-1) registered under Sections 302 , 307, 326, 323, 324, 427, 148, 149 IPC, 1860, Sections 25 /27/54/59 of the ARMS ACT , 1959 and Sections 3(1)(r) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities Act, 1989) at Police Station Sadar Patti, District Tarn Taran.
2. The present case came to be registered on the basis of a Ruqa sent by SI Nirmal Singh wherein it was alleged that a mutual fight had taken place between two parties i.e. Dhara Singh and Charanjit Singh. It was alleged that both the sides had attacked each and other and had received injuries in the occurrence. The relevant translated version of the FIR is reproduced hereinbelow:-

Grant of bail - when a co-accused has been granted bail by the High Court, then it would be justified to grant bail to another accused who is in Jail for more than one year.
The court ruled that allegations of grievous injuries justified denial of anticipatory bail due to the severity of the charges and roles of the accused.
The court denied bail based on the gravity of allegations involving incitement to violence, potential witness tampering, and the need to ensure trial integrity.
