Fact of the Case:

The accused-applicant, Guru Yadav alias Guru Charan, filed a bail application in a case involving multiple sections of the Indian Penal Code and the Criminal Law Amendment Act. The court considered the arguments of the applicant's counsel and the Additional Government Advocate, and found that there was no specific evidence to assign a role to the applicant in the commission of the offense. The court also noted an order passed in favor of a co-accused by the Chief Judicial Magistrate, which lacked convincing justification for rejecting bail.

The court, without commenting on the merit of the case, concluded that the accused applicant is entitled to be released on bail based on the lack of convincing reasons for the rejection of bail by the court below and the absence of corroborating evidence.

Issues: The issues involved in the case included the lack of specific evidence to assign a role to the applicant in the offense, the rejection of bail without convincing justification, and the absence of corroborating evidence.

1. Heard learned counsel for the accused-applicant, learned Additional Government Advocate and perused the record.

2. This bail application has been filed by the accused-applicant, Guru Yadav alias Guru Charan, who is involved in Case Crime No.153 of 2013, under Sections 147, 148, 149, 307, 332, 336, 353, 504, 506 , 188/34 IPC and 7 Criminal Law Amendment Act, Police Station Ibrahimpur, District Ambedkar Nagar.

3. Learned counsel for the applicant has argued that there is no evidence on the basis of which specific role can be said to have been assigned to the applicant in the commission of offence.
