Headnote:Panchayat Raj Evam Gram Swaraj Adhiniyam, 1993 (M.P.) -- S.95(1) r/w S.70(2) -- M.P. Panchayat Samvida Shala Shikshak (Employment and Conditions of Contract) Rules, 2005 -- R.6, Schedule II -- appointments of contract teachers -- shall be made as per concerned rules -- mere participation in selection process and qualifying the written examination will have no effect on ineligibility of not holding the requisite qualification.

       Held : In view of the aforesaid analysis, it is held that the petitioners who were not holding the requisite qualification which have been prescribed in the Rules, have rightly been found ineligible for appointment to the post in question. (2003)3 SCC 541 and (2003)3 SCC 548 followed. Writ Petition No.4529 of 2013, Writ Petition No.6559 of 2013 and Writ Petition No.6686 of 2013 relied on.

1A. These writ petitions relate to the recruitment to the post of Samvida Shala Shikshak Grade I, Grade II and Grade III (for short “Samvida Shala Shikshak”). Since respondents have not considered the petitioners for appointment to the post of Samvida Shala Shikshak on the ground that the petitioners do not possess the requisite minimum qualification prescribed for the post, therefore, the petitioners have approached this Court.
