Per G.A. Brahma Deva :
This is an application filed by the party for restoration of appeal which has been dismissed for default in appearance.
2. Shri Jawaharlal, ld. Advocate submitted that he took wrong date which resulted in dismissal of appeal. Instead of 25th Sept., 1997, he took the date as 15th Oct., 1997. On 15.10.97, when he appeared before the Tribunal, he came to know that he has taken a wrong date. He submitted that since there was a bonafide mistake on his part, party should not suffer for negligence of advocate. After hearing the ld. D.R. and taking all the averments made, we are inclined to restore the appeal and accordingly the appeal is restored to its original number. Matter is posted for regular hearing on 11.2.1998.
